Provisions of criminal laws

Criminal penalties for smuggling of Chinese cultural relics, precious metals, precious and rare species of animals or plants and their products

Any foreigner, who in intentional violation of the regulations and laws on customs and the protection of cultural relics of China, transports, carries and mails cultural relics banned for export in China, may commit the crime of smuggling cultural relics.

Any foreigner, who in intentional violation of the regulations and laws on customs and in escape of the supervision from the customs, illegally carries, transports and mails gold, silver or other precious metals banned for exportation in China to the outside of the territory of China, may commit the crime of smuggling precious metals.

Any foreigner, who in intentional violation of the regulations and laws on customs and in escape of the supervision from the customs, illegally carries, transports and mails precious and rare species of animals or plants and their products in and out of the territory of China, may commit the crime of precious and rare species of animals or plants and their products.

Any foreigner, who commits any of the above three crimes shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and in addition a fine shall be imposed on; if the circumstances are extremely serious, he shall be sentenced to fixed-term imprisonment of not less than ten years or lifetime imprisonment and a confiscation of property; if the circumstances are relatively light, he shall be sentenced to fixed-term imprisonment of not more than five years and in addition a fine shall be imposed on.

Any foreigner, who in intentional violation of the regulations and laws on customs and in escape of the supervision from the customs, illegally carries, transports and mails precious and rare species of plants and their products in and out of the territory of China, and may commit the crime of precious and rare species of plants and their products, shall be sentenced to fixed-term imprisonment or criminal detention of not more than five years, and or in addition a fine shall be imposed on; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years and in addition a fine shall be imposed on.
