Handling of road traffic accidents by traffic administrative departments of the public security organs in China

According to Provisions on the Handling Procedures for Road Traffic Accidents formulated by Ministry of Public Security of the People’s Republic of China, if a foreigner is suspected of fleeing away from the scene after causing a traffic accident or committing a crime of causing traffic casualties, traffic administrative departments of the public security organ can handle border control procedures in accordance with the relevant laws and regulations to prohibit him from leaving China.

Where a foreigner may bear civil compensation liability for road traffic accidents, traffic administrative departments of the public security organ shall notify the person claiming the compensation of the right to apply for prohibiting the foreigner from leaving China in accordance with law. Where the person claiming the compensation submits a written application, traffic administrative departments of the public security organ shall handle it in accordance with relevant regulations.
