Article 1

These Financial Support Measures are formulated for promoting industrialization, vigorously developing strategic emerging industries and realizing “innovation orientation and development transformation”.

Article 2

The “newly brought-in” enterprises referred to herein mean enterprises which have business registration in Pudong New Area after January 1, 2011 and whose taxation account administration is located in Pudong New Area. The “newly confirmed” enterprises mean enterprises that had business registration in Pudong New Area before January 1, 2011, whose taxation administration is in Pudong New Area, and who enjoy policies upon confirmation and approval after January 1, 2011. The “current” enterprises mean enterprises still existing at present which had business registration prior to January 1, 2011 in Pudong New Area and whose taxation administration is in Pudong New Area.

Article 3

When subsidies are specifically granted to an enterprise according to its contribution to Pudong New Area as provided herein, the administration is required to comprehensively consider actual development demand, economic contribution, technical innovation, employment promotion, energy savings and emission reduction, social credibility, production safety and other factors of the enterprise. The administration will perform comprehensive assessment and evaluation pursuant to a contribution evaluation index system for the enterprise.

Article 4

Pudong New Area supports industrialization of hi-tech projects and will offer certain auxiliary fund support for large important hi-tech industrialization projects approved and confirmed by the competent authority of Shanghai.

Article 5

Pudong New Area promotes development of strategic emerging industries. Certain subsidies will be granted to newly brought-in important hi-tech enterprises on the list of strategic emerging industry fields of Pudong New Area within six years according to their contribution to Pudong New Area if they are confirmed. Certain subsidies will be granted to other hi-tech enterprises of certain scale if they are confirmed.

Article 6

Pudong New Area supports clustering development. Certain subsidies will be granted to newly brought-in hi-tech enterprises within five years according to their new contribution to Pudong New Area. Certain subsidies will be granted to newly confirmed hi-tech enterprises within five years according to their new contribution to Pudong New Area.

Article 7

Pudong New Area promotes development of the hi-tech service industry. Certain subsidies will be granted to newly brought-in hi-tech service enterprises relying on high technologies and serving strategic emerging industries within five years according to their contribution to Pudong New Area if they are confirmed. Certain subsidies will be granted to newly confirmed hi-tech service enterprises within five years according to their new contribution to Pudong New Area.

Article 8

Pudong New Area promotes clustering development of strategic emerging industries. Certain subsidies will be granted to newly brought-in core enterprises in the science and technology industry base (industry park) established by renowned enterprises in strategic emerging industry fields within five years if they are confirmed. Certain subsidies will be granted to newly brought-in important auxiliary enterprises within five years according to their contribution to Pudong New Area if they are confirmed. Certain subsidies will be granted to newly brought-in ordinary auxiliary enterprises within three years according to their contribution to Pudong New Area if they are confirmed.

Article 9

Pudong New Area promotes incubation and cultivation of innovative enterprises. Certain subsidies will be granted to Shanghai science and technology enterprise incubators engaged in innovation incubation activities within five years according to contribution to Pudong New Area made by relevant business income if they are confirmed.

Article 10

Pudong New Area encourages enterprises to increase capital and expand production. When an enterprise in a strategic emerging industry increases capital and shares to a certain scale and proportion and its production capacity accordingly increases, certain subsidies will be granted to the enterprise according to its new contribution to Pudong New Area.

Article 11

Pudong New Area promotes transformation of hi-tech achievements. Certain subsidies will be granted to newly confirmed hi-tech achievement transformation projects with independent intellectual property rights within three years according to their contribution to Pudong New Area.

Article 12

Pudong New Area promotes upgrading of products. Certain subsidies will be granted for the newly confirmed new products according to their contribution to Pudong New Area.

Article 13

Pudong New Area supports development of hi-tech venture investment. When newly brought-in hi-tech venture investment enterprises carry out hi-tech venture investment businesses, certain subsidies will be granted within three years according to contributions made to Pudong New Area by relevant businesses if the businesses are confirmed.

Article 14

Pudong New Area encourages investment in hi-tech industry. When a hi-tech venture investment enterprise invests in a hi-tech enterprise in a strategic emerging industry of Pudong New Area, certain awards will be granted to the hi-tech venture investment enterprise according to the contribution to Pudong New Area made by the investee if the investment is confirmed.

Article 15

Pudong New Area promotes clustering of research and development institutions. Certain subsidies will be granted to newly brought-in research and development institutions conducting independent accounting within six years according to their contribution to Pudong New Area.

Article 16

Pudong New Area promotes introduction, absorption and export of advanced technologies. When a production enterprise in Pudong New Area pays expenses for introducing advanced proprietary technologies and makes contributions to Pudong New Area by exporting advanced technologies, certain subsidies will be granted to the enterprise if its actions above are confirmed.

Article 17

Pudong New Area supports technical reform of enterprises. Certain financial support will be provided for key technical reform projects of Shanghai and Pudong New Area.

Article 18

Pudong New Area supports development of scientific agriculture. Certain subsidies will be granted to confirmed leading agricultural enterprises above city-level within three years according to their contribution to Pudong New Area.

Article 19

Pudong New Area supports sustainable development of enterprises in strategic emerging industries. After current financial support policies enjoyed by hi-tech enterprises conforming to current strategic emerging industry orientation expire, certain subsidies will still be granted to the high-tech firms according to their contribution to Pudong New Area if they are confirmed.

Article 20

Supplementary Rules

(1) Where both relevant support provisions of higher authority and these Measures are applicable, the support provisions of higher authority shall always be implemented first. In case of inadequacy compared with these Measures after implementation, these Measures may be implemented as a supplement. The same support recipient may receive more favorable support but may not receive overlapping support.

(2) Enterprises enjoying the support herein shall continuously operate in Pudong New Area for more than 10 years from the year it receives support. If a support recipient is far from meeting comprehensive index assessment provisions, its qualification for financial support may be revoked and financial subsidies already granted may be withdrawn.

(3) These Measures shall be implemented as of the day of promulgation.
